Welcome to Gap Games! Thanks for joining our Affiliate Program.
These Terms & Conditions apply to individuals or entities participating in the Gap Games Affiliate Program as an affiliate (“you”) and to Gap Games as the merchant (“we”, “us”, or “Gap Games”).
By registering for or participating in the Affiliate Program, you agree to be bound by these Terms & Conditions. If you do not agree, you must not participate in the Program.
1. Approval, Rejection, and Ongoing Participation
Participation in the Affiliate Program is subject to approval at Gap Games’ sole discretion.
We reserve the right to:
- Approve or reject any affiliate application
- Suspend or terminate an affiliate relationship at any time
Where practicable, we will aim to provide at least 48 hours’ notice of termination. Immediate termination may occur where we believe there has been a breach of these Terms, reputational harm, or conduct inconsistent with the interests of Gap Games or its community.
2. Affiliate Links, Coupons, and Promotion
Affiliate links are automatically generated and may also be created for specific products or collections.
If a customer clicks multiple affiliate links, the most recent link clicked will be attributed for commission purposes.
Affiliates may be issued a branded coupon code at Gap Games’ discretion. Where a coupon is not assigned, affiliates must not promote or distribute any Gap Games discount codes.
Affiliates may promote Gap Games through approved online or offline channels, provided such promotion:
- Is accurate and not misleading
- Does not misrepresent the affiliate as an employee, owner, or official representative of Gap Games
- Does not conflict with these Terms
Use of affiliate links or coupons for personal purchases or self-referrals is strictly prohibited. Affiliate links are intended solely for referring new or existing customers, not for generating personal discounts or kickbacks on the affiliate’s own purchases. What you use your affiliate earnings for once earned however, is up to you!
Use of affiliate links or coupons is not designed to be used in combination with hallmark Store sales (included but not limited to Black Friday, Boxing and Birthday sales.
3. Commissions and Payments
Affiliates may earn commission on completed and paid transactions referred through approved affiliate links or coupons, in accordance with the current commission structure.
Commissions are calculated on the order value excluding taxes, shipping, and additional fees.
To receive payment, affiliates must provide accurate payment details via their affiliate dashboard. Payment schedules and thresholds will be communicated separately.
Gap Games reserves the right to:
- Review referral transactions for fair use and compliance
- Withhold or reverse commissions related to refunded, cancelled, fraudulent, or disputed orders
- Suspend commission payments during investigation of potential breaches of these Terms
Affiliates are responsible for their own tax obligations.
4. Marketing Assets and Brand Use
Gap Games may provide marketing assets such as logos, banners, or promotional materials.
Affiliates are granted a limited, revocable, non-exclusive licence to use approved assets solely for participation in the Affiliate Program.
Affiliates must not:
- Modify brand assets without permission
- Use Gap Games branding in a misleading or comparative manner
- Use Gap Games assets in connection with competing retailers or promotions
All rights to Gap Games intellectual property remain with Gap Games.
5. Network and Downline Affiliates
The Gap Games Affiliate Program does not currently support multi-tier, network, or downline affiliate structures.
Affiliates must not recruit sub-affiliates, operate referral networks, or represent the Program as offering tiered or network-based commissions unless explicitly approved in writing by Gap Games.
Gap Games reserves the right to introduce, modify, or prohibit such structures in the future.
6. Cookies and Tracking
Affiliate tracking relies on cookies. Customers must allow cookies for referrals to be tracked.
If cookies are disabled, blocked, or cleared, Gap Games may be unable to attribute commissions.
The applicable cookie duration is stated at the time of affiliate registration. Tracking begins when a customer clicks an affiliate link or uses an affiliate coupon.
7. Competing Affiliates and Conflicts of Interest
Affiliates must not promote, be a representative affiliate, ambassador, sponsorship, or promotional programs for competing gaming or hobby retailers operating within the state of Queensland, Australia without prior written approval from Gap Games.
Affiliates must disclose any existing or proposed relationships with other retailers, stores, or gaming venues that may reasonably be considered competitive.
Gap Games may approve or decline such arrangements at its discretion. Approval may be conditional and may be withdrawn at any time.
Failure to disclose or unauthorised participation in competing affiliate programs may result in immediate suspension or termination and forfeiture of unpaid commissions.
8. Removal from the Affiliate Program
Affiliates may request removal from the Program at any time by contacting contact@gapgames.com.au.
Upon termination or removal:
- All rights to use affiliate links and Gap Games assets cease immediately
- Outstanding commissions will be handled in accordance with these Terms
9. Gap Games Mantra and Community Standards
Gap Games supports inclusiveness, diversity, and respectful community engagement. We are LGBTQIA+ friendly and believe gaming should be welcoming and fun.
Affiliates must not engage in behaviour that is discriminatory, harmful, defamatory, or detrimental to Gap Games, its community, partners, or suppliers.
Conduct inconsistent with these values may result in immediate termination of affiliate participation.
10. Changes to These Terms
Gap Games may update these Terms & Conditions from time to time. Continued participation in the Affiliate Program constitutes acceptance of the updated Terms.
